Abstract:
Racism and xenophobia remain serious challenges to those who migrate across international borders, whether they do so voluntarily or involuntarily. Protections against racial discrimination for non-citizens exist in international law but the application of these protections is not straightforward and permits of exceptions that seemingly undermine these protections. Furthermore, racism and xenophobia are not variables independent of the legal and policy frameworks applicable to non-citizens. Instead, racism and xenophobia shape the very laws and policies applicable to international migration and displacement.
