Abstract:
This entry discusses the content and scope of readmission agreements, which are international accords addressing ‘procedures, on a reciprocal basis, for one state to return non-nationals in an irregular situation to their home state or a state through which they have transited.’ After some terminological clarifications on terms linked to readmission, this entry deals with the relationship between interstate and EU readmission agreements, and then elaborates on the question whether general international law generates an obligation upon states to readmit their own and foreign nationals, and, if so, how this obligation relates to readmission agreements. Finally, the risks connected to the informalization of readmission agreements, especially for the rights of asylum seekers, as well as the questionable interlink between readmission and incentives, such as visa facilitations, financial and technical aid, and development assistance, are addressed as some of the main challenges of this subject matter.
