Abstract:
The Schengen area is about much more than the abolition of border controls among the member states of the European Union (EU). Doing so served as a laboratory for the design of new control instruments, including the proliferation of migration databases and the border agency Frontex. Contemporary challenges comprise the frequent reintroduction of internal border controls, ‘pushback’ allegations against the border police of several member states, and prevalent externalization practices. All these debates unfold within the institutional framework of the EU nowadays, following the incorporation of the original Schengen Convention into Union law. Essential pieces of supranational legislation, which build upon the original rulebook, include the Schengen Borders Code Regulation, the Visa List Regulation, and the Visa Code Regulation; they contain detailed prescriptions for external border controls and tourist visas.
