Abstract:
This chapter explores refugee protection in Latin America by presenting the two structural pillars of its protective architecture of refugee law and policy - i.e. its regional concept of refugee and its dialogue with human rights. It delves into the regional tradition of asylum and the different modalities through which the right of asylum is implemented as consolidated in regional instruments and practice. The chapter unpacks the relevance of the Cartagena Declaration in terms of both the regional refugee concept and the protective dialogue between human rights and refugee law, with special attention to the Inter-American Court of Human Rights practice as a catalyst and standard-setting regime of protection. It demonstrates how this dialogue between refugee law and human rights opens a pathway for integral protection. Lastly, the chapter focuses on national policies and practices towards protection, through protection mechanisms but also as trend setters of good practice.
