Climate refugees in India and international law: convergences divergences and anomalies

Abstract:
This chapter analyses the existing legal framework for refugees in India. Specifically, it focuses on the legal aspects of climate refugees. Accordingly, the first section covers the existing laws pertaining to climate refugees globally. It looks at the challenges from the perspective of international refugee law, international human rights law, and domestic laws. The second portion sketches India’s refugee policy and its inability to address the impending climate refugee crisis. It is concluded that on the global front, there are normative gaps in addressing the issue of climate refugees. In India, the burden shifts to the courts to fill the legislative and executive lacuna because of a lack of uniform and effective policy.
