A constitutional reading of EU citizenship law

Abstract: This chapter joins constitution-focused and citizenship-focused discourses, providing a method for reading Union citizenship law through the lens of the EU's changing constitution. It considers how relevant Lisbon Treaty amendments coexist with established principles of EU Law and highlights, more recently, the Court of Justice's increasing attention to Article 2 TEU and the Charter of Fundamental Rights. The chapter re-positions some of the more controversial developments in the case law where the Court was called upon to determine the extent of the protection that EU primary law, in particular, actually affords to the Union citizen. Ultimately, a constitutional reading of EU citizenship law is important because it ensures that the rights and obligations associated with Union citizenship are in sync with the values and principles promoted by the EU's constitutional framework and shared by all 27 Member States.
