Permeability, sincere cooperation, dialogue: ensuring integrative pluralism

Abstract: This chapter focuses on three key principles of integrative constitutional pluralism: permeability, sincere cooperation and dialogue. It is based on the premise that the European constitutional architecture has a pluralist structure, being composed of different autonomous constitutional levels, national and European. The principles of integrative constitutional pluralism are designed to turn these independent constitutional levels into a functional unit. By fostering mutual openness, coherence and responsiveness, they transform mere constitutional plurality into integrative pluralism. In a first step, the chapter addresses permeability, ie the principle of opening up the constitutions of the Member States and of the Union to one another and beyond. Subsequently, the chapter focuses on the principle of sincere cooperation, emphasising its pivotal role in ensuring mutual consideration and loyalty. The chapter then moves on to examine the concept of dialogue, frequently articulated through specific procedural arrangements, yet also fundamental as an overarching, cross-cutting principle.
