Abstract:
This chapter examines the single economic entity doctrine under EU competition law. Specifically, it explores the question of what is the proper objective of the doctrine and some practical issues regarding the application of the doctrine, including (1) whether the AKZO presumption should be practically irrebuttable; (2) whether the doctrine should allow differential application; and (3) whether the doctrine should allow the imputation of liability to subsidiaries.
