Dialogue 3 Restoring what has never been
.
Chapter 3 in Socratic Voices, 2023, pp 32-53 from Edward Elgar Publishing
Abstract:
Restorative justice mapped onto the traditional distinction between distributive and commutative (retributive) justice, i.e., sharing and levelling. Distribution as (by definition) redistribution. Redistribution as commutative justice, with criteria derived from a just ordering rather than a past ordering of society. Difference between (i) restoration of the rule of law; (ii) restoration of rights; (iii) restoration of a just political order.
