Abstract:
This chapter examines the protection of Graphical User Interfaces (GUIs) under the Hague System and within the principal designating jurisdictions. It begins with a definition of GUIs and an account of their growing economic importance, illustrated by the figures published in the Hague Yearly Review, and identifies Locarno subclass 14-4 as the primary classification while noting that GUI designs may also appear in other classes. It then explores the national peculiarities of China, the Republic of Korea, Japan, the United States and the United Kingdom, addressing static and dynamic interfaces, augmented and virtual reality displays, partial-design requirements, the use of solid versus broken lines and titling conventions. The chapter concludes with strategic advice on selecting key visuals, drafting product indications, depicting transitions, and avoiding common pitfalls relating to unity of design and animated sequences when seeking effective international protection of GUI designs.
