Carceral animal law
Justin Marceau
Chapter 23 in Elgar Concise Encyclopedia of Animal Law, 2025, pp 88-90 from Edward Elgar Publishing
Abstract:
The law is generally inhospitable to animals. It treats them more like things than beings, and progress in the law has been slow; some would say almost non-existent. One area that many lawyers point to as a sign of progress and success is the criminal law. For decades, a shared belief among animal lawyers was that more prosecutions, more convictions, and longer sentences for animal abuse or neglect were an important foundation of legal success for animals. The belief that progress for animals can be obtained through criminal prosecutions is carceral animal law.
