Equine litigation

Elaine K. Fresch and Amanda Z. Weaver

Chapter 36 in Elgar Concise Encyclopedia of Animal Law, 2025, pp 140-143 from Edward Elgar Publishing

Abstract: Equine litigation can involve a host of different types of lawsuits. The most common case involves injury to a person. This can include not only injury to someone riding a horse, but also injury to someone handling the horse, or to a spectator at an equestrian event. Claims involving injuries to horses can also end up in litigation, particularly when the horse has significant value. Finally, disputes over the purchase and sale of a horse can result in a lawsuit being filed with claims ranging from misrepresentations of the horse's soundness or past performance, to agents obtaining secret profits. Equine welfare may also be litigated through common law or statutory negligence actions.
