Abstract:
Many humans in the US have within their family units one or more domestic companion animals [pets]. Many humans who consider their pets as family members would like the opportunity to specifically include their pets in their estate planning. A particularly powerful tool that can be used for the care of pets is a trust that is commonly referred to as a ‘pet trust’. The trust provides for the care of a designated pet(s) and terminates upon the death of the pet(s). For jurisdictions that do not recognize pet trusts, one can include reference to the pet in the more traditional estate planning documents.
