Living property – new legal status for animals

Abstract:
There are presently three categories of property in the world of law: real property (land), personal property (things), and intellectual property (ideas and creativity of potential commercial value). The visibility of animals within the legal system has always been clouded by the reality that their status is personal property. Traditionally, this limits their value recognized by the law to that of economic value. However, in the area of companion animals, other values such as an animal's inherent self-worth and the emotional value to humans are being asserted and recognized. This process is moving companion animals out of the traditional personal property box to a new category that may be referred to as ‘living property’.
