Overview of US animal law

Bruce Wagman

Chapter 85 in Elgar Concise Encyclopedia of Animal Law, 2025, pp 328-331 from Edward Elgar Publishing

Abstract: American animal law is comprised of national, statewide, and local laws that govern the treatment of animals. Animals owned by people are considered the personal property of their owners, although the law may limit what an owner can do with that property. For example, certain defined acts of cruelty to animals are prohibited, regardless of ownership, but those are defined by the relevant laws. Federal laws cover the use of animals in commerce and research, in agricultural production, and wildlife in danger of extinction. State laws parallel the federal laws but also focus more on specific types of treatment of animals.
