Abstract:
There is no general right to remove or assist non-human animals from cruel conditions. The legal status of an animal is that of personal property and not of a legal being. Yet proponents of the ‘open rescue’ movement have developed a strategy to expose the public to everyday animal exploitation while using the judicial system, and especially the jury trial, to promote changes to the common law.
