Unidroit Principles and CISG: A first and a second look

Abstract: The aim of the chapter is to explore the relationship between the Unidroit Principles and CISG considering their complementary role but also their divergencies. The work intends to answer the question on whether the Unidroit Principles have gained the momentum to be considered the general principles on which the CISG is based, as well as to look at the relationship between CISG and UPICC from a dynamic approach towards the interpretation of the CISG and the need to take the UPICC into account before resorting to domestic law. Finally, the chapter takes a first look to the material scope of application of the CISG at the light of the fourth edition of Principles on long-term contracts.
