The Unidroit Principles and the harmonization of contract law in West and Central Africa

Abstract: Nearly a decade ago, the Organization for the Harmonization of Business Law in Africa launched a highly ambitious project for the development of a Uniform Act on Contracts based on the Principles of International Commercial Contracts elaborated by Unidroit. Alas, the project was ultimately abandoned and the Uniform Act on Contracts never saw the light of day. Following a short overview of what OHADA is, the contribution will sketch the background of former and current projects for the unification of contract law in West and Central Africa. Moreover, it will take a closer look at how the Unidroit Principles may still be used as a model for the harmonization of the rules applicable to commercial contracts in the OHADA region.
