Analysis of the concepts used

Chapter 1 in Theories of Legal Relations, 2023, pp 18-45 from Edward Elgar Publishing
Abstract:
The expression ‘legal relationship’ exists in all current communication languages and even in some of the ancient ones. The unification of the concept of legal relationships in Germany at the beginning of the 19th century took place in a romantic context and that its expansion in Europe and the Western world seems to be linked to other forms of romanticism. However, the acculturation of the concept of legal relationships in non-Western systems does not seem to be linked to romanticism. It is, therefore, necessary to admit that there is a cultural diversity underlying the understanding of legal relationships, which does not prevent it from becoming a universal concept. The analysis can be carried out by distinguishing between ancient and medieval influence, romantic influence, and the universalization of the concept.
