Energy investments under the evolving framework of international investment law

Abstract: The chapter provides an overview on current developments present in the field of international investment law, discussing the general recognition of public policy objectives, the growing emphasis on sustainability considerations within the regime, the recognition of investors’ responsibilities, the growing relevance of investment facilitation, as well as the current developments in the EU’s internal market in relation to investment protection and investor-state dispute settlement. These paths of development are likely to have significant effects on the future legal framework of energy investments, which, in turn, are recognized to play a key role in the energy transition.
