Between over-sovereignty and under-sovereignty: symbolic force and transconstitutional limits of state sovereignty

Abstract: This chapter tackles the ambiguous concept of state sovereignty, distinguishing between its symbolic and normative dimensions. Neves asserts that sovereignty–especially since the Peace of Westphalia and the adoption of the United Nations Charter–has often functioned as a symbolic construct, used to legitimize state decisions even in the absence of genuine normative authority. The analysis then turns to how the challenges and limits posed to sovereignty by transconstitutionalism unfold through the interaction of different legal orders–international, supranational, transnational, and customary.
