The governance of UAS in EU law

Abstract: The regulation of “unmanned” aircraft vehicles and systems (UAVs and UAS), that is, European Union (EU) drones law, represents a complex normative field, which hinges on the Basic Regulation from 2018 and includes the delegated and implemented regulations of the European Commission (EC), as well as the opinions, guidance materials (GMs), and the “notice of proposed amendments” (NPAs) of the European Aviation Security Agency. After NPA 2022–06 regarding rules and standards for the operation of air taxis in cities and the Commission Implementing Regulation (EU) 2023/203 (European Commission 2023), further acts are to be expected to attain the goal of the Basic Regulation, namely, a legal framework on single skies and segregated airspaces for UAS that should be fully implemented any time soon. The chapter illustrates this work in progress, fleshing out the specific features of EU law, such as the modularity, adaptability, and scalability of its regulations, and the role that Member States (MS) play in this context pursuant to the subsidiarity principle.
