Regulatory governance of Australia's major airports: light-handed regulation 20 years on

Abstract:
Major airports in Australia with significant market power have been subjected to light-handed regulation over a period of 20 years, involving monitoring and three periodic reviews. The governance arrangements for the regulation are described, and the effectiveness of the arrangements is assessed. The degree of transparency provided by the framework and the credibility of the threat of stronger regulatory action if an airport exercises market power are two issues identified with the current approach to light-handed regulation. Despite these weaknesses, stakeholders support the continuation of a negotiated approach to the determination of airport prices and terms and conditions. After 20 years of experience, a new direction in light-handed regulation is indicated, which could involve improving the provision of information in the negotiation processes and effective dispute resolution.
