A necessary conversation: understanding rehabilitation within a holistic right to health for persons with disabilities

Abstract:
This chapter argues for a holistic interpretation of the rights to health and rehabilitation under the Convention on the Rights of Persons with Disabilities. It conducts an analysis of the travaux préparatoires from the drafting committee, demonstrating the clear attempts to separate these two concepts. It also conducts an empirical analysis of the Concluding Observations by the Convention Committee between May 2011 and September 2024 to identify how the Committee understands the definition, application, and operation of rehabilitation within human rights. Through this research, the immediate priorities of the Committee become clear and demonstrate the interconnected nature of health and rehabilitation. As such, though the rights to health and rehabilitation are drafted into separate articles, they are understood and applied together. Therefore, this chapter starts the conversation on interpreting rehabilitation rights, both within and beyond the context of a right to health.
