Abstract:
This chapter sets out the scope of the Research Handbook. It looks at understandings of how domestic violence have evolved and outlines how the contributors will analyse ‘coercive control’ as a form of abuse that is increasingly recognised in legal definitions across the world. It discusses the human rights context for recognition of domestic abuse and appropriate responses in civil, family and criminal justice systems. It highlights how those accessing protection orders in different countries face similar issues; limited funding and inadequate legal representation. Additional barriers (ethnicity, immigration status, sexuality) for survivors are discussed. The Handbook contextualises the global issue of how family courts deal with domestic abuse and counter allegations of parental alienation, in particular, comparing the UK to Australia. It concludes by overviewing contributions on the criminal law and criminal justice responses to domestic abuse, again through a comparative lens.
