Abstract:
This chapter considers the barriers that women as suspects/defendants face in being identified as victims of domestic abuse and having their experiences being taken into account by the criminal courts. The chapter draws on original empirical research with women in this position, which makes a compelling case for reform to the law and policy in this area. It explores the need for further education of all those involved in criminal proceedings about the nature and dynamics of domestic abuse, and for practitioners to draw on available learning from existing models of practice to help facilitate disclosure of abuse and ensure it is properly taken into account in proceedings.
