Prosecuting and sentencing domestic abuse in Scotland

Abstract: This chapter will focus on the prosecution and sentencing of domestic abuse following the introduction of the Domestic Abuse (Scotland) Act 2018. It will call attention to emerging inconsistent practices in court procedure and sentencing across a comparatively small jurisdiction. It will be argued that, despite the existence of a criminal offence which captures coercive control effectively, there is not always consistent implementation of the law. As such, there remains much to be done if Scotland is to be considered a leader in criminal law responses to domestic abuse.
