‘Contrasts in Tolerance’: on the benefits of a cross-sectoral approach to youth penality

Abstract:
While much academic ink has been spilled on developments in youth justice from the 1980s to the present time, few studies have examined ‘contrasts in tolerance’ within the justice system itself. The aim of this chapter is to address this lacuna through cutting-edge research comparing and contrasting the youth, adult and young adult systems in Ireland and the Netherlands. All of these countries have reputations for progressive or innovative youth justice systems, although the same cannot always be said of the adult or young adult justice systems within the same countries. Drawing on empirical research carried out in these countries, the chapter argues that a cross-sectoral approach to penality can provide fresh perspectives on apparent differences of approach within and between justice systems, as well as key determinants (‘risk’ and ‘protective’ factors) of penal policies.
