Abstract:
This chapter explores decentralised borrowing and lending and analyses whether the definitions for the activity of ‘operating an electronic trading platform’ in the Regulated Activities Order will apply to Decentralised Finance (DeFi) protocols, and whether DeFi capital pools may be considered collective investment schemes. It also considers the similarities between centralised ‘DeFi’ projects and traditional financial services providers, using the Celsius bankruptcy as an example.
