Financial services regulation Part 3: Other applicable provisions
.
Chapter 8 in Financial Services Law and Distributed Ledger Technology, 2024, pp 175-203 from Edward Elgar Publishing
Abstract:
This chapter sets out a range of additional financial services rules that may have an impact on the use and sale of cryptoassets in financial services (whether regulated or unregulated), including the financial promotion regime, the market abuse rules, the listing and prospectus regime and the Senior Managers and Certification regime. All of these rules can be applied to crytpoassets, although the level of centralisation of the governance structures of a specific digital asset project may determine how and to whom the rules can be applied.
