Abstract:
This chapter evaluates the activities and circumstances in which tokens may fall within the definition of securities. The chapter considers the evolving regulatory landscape and the extent to which cryptoassets that may constitute regulated securities, whether under the Regulated Activities order or the EU’s MiFID II regime, as retained, fall within the scope of the regulatory perimeter.
