Chapter 19 in The Elgar Companion to Decent Work and the Sustainable Development Goals, 2025, pp 236-246 from Edward Elgar Publishing

Abstract: The contribution will give an overview of the International Laws and Rules for the Right to Work for People with Disabilities. In special it will address Article 27 of the United Nations Convention on the Rights of Persons with Disabilities (CRPD) in the context of the CRPD’s goals of non-discrimination including reasonable accommodation, accessibility, and inclusion. Moreover, the ILO-Convention 159 - Vocational Rehabilitation and Employment (Disabled Persons) Convention, 1983, will be described. The concept and definition of disability will be discussed in the context of these documents and of the International Classification of Functioning, Disability and Health (ICF) of the World Health Organization. Typical problems of the right to work and employment of people with disabilities will be discussed in the light of UN and ILO-documents, national legislation and jurisprudence and academic contributions. Important topics are sheltered work, employment duty and levy systems, (non-)discrimination in the access to employment and inside employment, accessibility of workplaces and participation and trade union rights for people with disabilities. Finally, this content will be set into the context of the SDGs, especially SGB 8.5. and 10.2., with a critical view on the topic of vulnerability, and to the Decent Work Agenda of the ILO.
