Abstract:
The chapter examines the policy implications of corporate due diligence in global value chains (GVCs) for decent work. It first traces the evolution of due diligence as a key concept in the regulation of human rights and sustainability in GVCs, highlighting its origins and current legal frameworks, and then focuses on the case of the German Supply Chain Due Diligence Act. The analysis reveals the limitations of due diligence, highlighting the concept’s reliance on powerful lead companies, risk-based management prioritisation and a blurred public-private accountability divide. These factors contribute to a complex landscape where the implications for labour rights enforcement remain ambivalent. In conclusion, the nuanced role of legal regulation as a contested field should be acknowledged: the future impact of due diligence on decent work in GVCs will largely depend on ongoing legal struggles and the ability of workers to navigate the intricacies of transnational labour rights enforcement.
