Abstract:
Regulation (EU) 2019/2033 (the so-called IFR) and Directive 2019/2034 (the so-called IFD) of 27 November 2019 aim at clarifying the prudential and regulatory regime applicable to investment firms of the European Union, in a context where the dual application of the provisions of MiFID II and CRD to certain of those institutions could lead to confusion. IFR and IFD seek to introduce appropriate and proportionate prudential arrangements depending on the nature and volume of the activities of investment firms, that is, depending on the ‘class’ of investment firms.
