Chapter 43 in EU Banking and Financial Regulation, 2024, pp 441-447 from Edward Elgar Publishing

Abstract: The CBDF Legislation, composed of the CBDF Directive and the CBDF Regulation, aims to (i) harmonise national laws and procedures and (ii) reduce barriers on the cross-border distribution of collective investment funds across the EU. To achieve these objectives, the CBDF Legislation introduces in particular (i) a harmonised definition and conditions for the pre-marketing of funds by AIFM, EuSEF and EuVECA managers, (ii) requirements applicable for local facilities to UCITS and AIFs for retail investors and (iii) new requirements for marketing communications.
