Abstract:
The origin of the right of communication to the public, including the right of making available to the public, shows that different nation-states devised diverse legal solutions for essentially the same legal problem: how to ensure that rightholders receive remuneration for acts that enable audiences to see or hear their work. The inclusion of technology of transmission - through wireless (broadcast) and wire (cable) means, and then inclusion of on-demand technology - through the internet - demonstrated the need for a harmonised international solution to the problems that arise in connection with attempts to widen the audience. Chapter 4 in this description and analysis of international harmonisation of diverse legal solutions for widening of an audience focused on two main issues. The first one was the creation of technology driven provisions, and the second was the extent of harmonisation that was made on the international level.
