Chapter 9 in The Autonomous Legal Concept of Communication to the Public, 2023, pp 237-245 from Edward Elgar Publishing

Abstract: This book provides the scope of the economic right of communication to the public, including the right of making available to the public in the EU legal order. This purpose was set in order to clarify the limits of this economic right in digital realities and, consequently, to make the online availability of content - both for the rightholder and the end user - easier. There are three types of conclusions this book makes. The first is what types of copyright-relevant actions are in the scope of this economic right. The second is who are the persons who can make use of this economic right. The last is how one assesses infringement of this economic right. The concluding remarks, firstly, present reflections and conclusions on the scope of the legal concept of the economic right. Secondly, they present an operational model for future use that can aid in identifying and remedying infringements.
