Legitimizing power in multilevel governance

Abstract: The legitimacy of multilevel governance has been a matter of continuing research and discussion. This chapter reconsiders the well-known dilemma of effectiveness and democratic legitimacy. Democracy, meaning governing according to the will of the people, requires a congruence of a demos and political authority. Hence, the coordinated execution of political authority across the borders of jurisdictions cannot be democratic. However, multilevel governance is necessary to give a voice to the people who are affected by external effects but cannot hold the responsible government to account. To solve this conundrum, the chapter explicates to what extent modes of legitimizing the distinct types of transboundary power harmonize with standards of democracy. Provided that multilevel governance is embedded in well-functioning democracies at different levels of government, these modes can turn executive governance into democracy-conforming multilevel governance.
