Chapter 5 in Automated Decision-Making and Effective Remedies, 2023, pp 117-147 from Edward Elgar Publishing

Abstract: Determining which review body of which jurisdiction is competent to undertake a practical review of what type of conduct does not only imply identifying its ‘geographical’ location. It also implicates the question of the scope of such competence. This chapter outlines how the remedial competences under EU law are organised along the interrelated level, territory, subject matter, and admissibility considerations. The chapter then assesses the remedial architecture and allocation of jurisdiction in semi-automated decision-making.
