Accountability for the violation of the right to development: prospects and challenges

Abstract: After decades of controversy on the right to development, the latter formally ascended into the realm of human rights in 1986 with the adoption of the 1986 UN Declaration on the Right to Development. This recognition of the right to development automatically turns the right into an entitlement, with duty bearers who can be held accountable for its violation. Accountability for violation of the right to development has been epitomized by the African Commission on Human and Peoples’ Rights as well as the African Court on Human and Peoples’ Rights, which have held states accountable for such violations. Against this backdrop, this chapter examines the prospects and challenges for holding duty bearers of the right to development accountable for its violation. To this end, the chapter discusses the normative content of the right to development, explores its duty bearers, and focuses on the latter's accountability for its violation.
