Accountability for LGBTI human rights violations

Abstract: LGBTI persons are entitled to all the human rights guaranteed by international law to everyone. Still, various human rights violations based on SOGIESC occur in all corners of the world, raising issues of securing accountability for such violations. This chapter focuses on challenges in international accountability for SOGIESC-based human rights violations, particularly through the mechanisms of UN treaty bodies. The lack of explicit LGBTI language in the core human rights treaties defines the need for interpreting the existing norms to recognise state and non-state actors as duty bearers, LGBTI persons as right holders, and to ensure accountability for violations of their human rights. The chapter provides an overview of various LGBTI cases on topics such as the criminalisation of same-sex intimacy, SOGIESC-based violence and discrimination, diverse families, and legal gender recognition. It demonstrates how the interpretation of the rights to non-discrimination and privacy, as well as other rights, creates avenues to ensure accountability for LGBTI human rights violations. The chapter further investigates possible remedies for SOGIESC-based violations that consider the specific needs and vulnerabilities of LGBTI persons. It concludes by highlighting some possible areas for future exploration.
