Abstract:
This chapter focuses on the varied challenges faced by investigators and prosecutors in proving corruption. It considers the different ‘categories’ of corruption-related activities and their unique investigation and prosecution challenges as well as the need for unique responses. It highlights the Golden Triangle approach: i.e., that there must be fairness to all sides and this involves taking into account the position of the accused, the victim and his or her family, and the public interest in combating corruption. It doing so it explores the key issues raised by the constitutional right to a fair trial.
