Housing and the right to equality and non-discrimination

Abstract: In the face of massive inequalities, it might be surprising to find that whether the right to equality responds to housing inequalities is vigorously contested. To explore the contours of this debate, this chapter examines two aspects of the relationship between housing and the right to equality and non-discrimination. First, the question of whether material equality is part of the human rights project; second, the issue of equality and housing conditions for women. Before addressing these two aspects, the chapter explains the meaning and scope of equality and non-discrimination as protected in international human rights law to set the scene for understanding what the right to equality – and related right to non-discrimination – mean, and hence why there is a debate about whether the obvious inequalities in material standards of living and in life chances that we see around us are, in fact, problems in terms of a right to equality.
