Housing and the right to self-determination for Indigenous peoples

Abstract: This chapter describes the issues facing Indigenous peoples in the area of housing, setting this within the context of colonialism as background to Indigenous experience. Noting that self-determined housing is required for the realization of Indigenous rights, it then turns to self-determination as a concept, arguing that self-determination has two intertwined lives: one circumscribed by international law and state authority, and a second sovereign life that refuses these constraints. Every struggle for the right to self-determined housing will take place within the bounds of international law and state imposed legal orders, but will also demonstrate the ability to push beyond. The chapter demonstrates this with attention to three case studies in Canada: Indigenous-driven definitions of Indigenous homelessness; homeless encampments; and the Squamish Nation's Sen̓áḵw development in Vancouver.
