Abstract:
This chapter explores how measures intended to promote sustainable energy transition and climate mitigation can create exclusionary and discriminatory barriers for developing economies. The chapter highlights the challenge of upstream regulations, particularly ‘forward-looking ambition’ standards, and argues for a more progressive interpretation to prevent the institutionalization of unrealistic entry barriers for downstream economies, ensuring more equitable access to sustainable investments.
