Abstract:
This chapter explores the implications of ‘norming’ the right to a healthy environment, focusing on its potential impact on climate mitigation. The chapter examines how climate change intersects with human rights and how this entanglement informs the normative development of the right. The term ‘norming’ encompasses both the legal and sociological evolution of this right, its journey towards becoming a binding legal norm, and its recognition globally. The chapter reviews the right's evolution, analyses its current content and obligations, in particular its role in climate change mitigation, and discusses its implications for future human rights cases and international climate efforts.
