Abstract:
This chapter examines potential pathways for transforming international investment law to support the transition to a low-carbon economy. The chapter first explores the role of foreign investments in climate change mitigation, emphasizing the intersection of international climate and investment law. It then traces the evolution of international investment agreements, highlighting how earlier generations overlooked environmental and climate concerns, while more recent agreements have started to incorporate them. Building on this evolution, the chapter proposes three avenues for reforming international investment law to better align with climate goals.
