Post-grant proceedings
Toshiko Takenaka
Chapter 11 in The Law and Theory of Patents, 2026, pp 221-262 from Edward Elgar Publishing
Abstract:
This chapter examines the central role of post‑grant proceedings in reassessing patent validity once rights have issued, especially for patents that competitors seek to commercialize. Although TRIPS does not require post‑grant review, its standards for fair and equitable enforcement support national mechanisms that allow competitors to challenge validity under judicial oversight. Post‑grant procedures correct erroneous grants, promote legal certainty, and balance innovation incentives with public access.
