Extent of patent protection
Toshiko Takenaka
Chapter 13 in The Law and Theory of Patents, 2026, pp 294-355 from Edward Elgar Publishing
Abstract:
This chapter analyzes how patent systems determine the scope of protection through claim interpretation, application to accused embodiments, and the doctrine of equivalents. While TRIPS sets minimum standards, national jurisdictions diverge in balancing patentee protection with legal certainty, reflecting competing peripheral versus central interpretive traditions.
