Patent application – disclosure requirements

Toshiko Takenaka

Chapter 8 in The Law and Theory of Patents, 2026, pp 153-179 from Edward Elgar Publishing

Abstract: This chapter analyzes the disclosure and claim requirements that form the patent system's quid pro quo: exclusive rights in exchange for a public disclosure enabling others to practice the invention. Grounded in TRIPS Article 29, it examines how enablement, written description or support, and claim clarity operate in the United States, Europe, and Japan to limit claim scope to the inventor's actual technical contribution and to prevent applicants from capturing unexplored or post‑filing developments.
